Elements of Design in the Green Mile Essay

The Green Mile is an exceptional film that was created in the year 1999. This film was nominated for four academy awards: Best Supporting Actor, Best Picture, Best Sound, and Best Adapted Screenplay. This movie teaches us how different the times were back in the 1900s compared to the way it is now. The movie is set in 1935 which was during the times of the Great Depression. It also illustrates death row and how execution is still a problem to where it is not just and fair. There are several well-known actors that cast in this film. Each actor plays a very unique role and elements of design have a role where it puts everything about this movie into perspective. The cinematographer that helped to create this film had a vital role in putting all of his screen shots together to generate the perfect lighting, images that are seen by the camera, and images that the audience sees upon completion of the film (Goodykontz & Jacobs, 2011). The director, producer, screenwriter, and composer all played important roles in putting this film together to show its exceptional potential at being nominated for four academy awards. The elements of design in the Green Mile are a form of art which cannot be duplicated in a way that they have come together to create this finished product. There is a scene in this film called â€Å"Miracle Worker†. In this particular clip, illustrates how the actors are placed into the scene and positioned on the set. You will see how well their costumes and makeup are done which is part of what makes up the mise en scene. The mise en scene is all of the elements in a film that the audience sees such as the setting, make up and costumes, as well as the movement and placement of the actors. The director, Frank Darabont, is responsible for shooting many different versions on a scene (Goodykontz & Jacobs, 2011). The director will then create the final film based upon the best of those elements. Some directors will allow improvisation which is when actors come up with their own lines that they feel will fit into a particular scene. The production designer, who is also sometimes called the art director, is responsible for maintaining the sets, props and the costumes so that they are in sync with the story and the character’s role (Goodykontz & Jacobs, 2011). Production designers are head of the department on film crews and they are responsible for the art department. Basically, they may be asked to look at scripts to decide how much time the art department needs to spend on films. They also calculate the budgets to figure out how much money will be spent as well. Furthermore, they will provide their design sketches expressing detailing mood, lighting, composition and color to the art directors who oversees the production (Anonymous, 2012). In this scene, the â€Å"Miracle Worker†, the lighting is low because it is night time, but there are lights on inside of the house in the bedroom where the warden wife is lying in bed. The lighting is very dim which evokes a depressing and gloomy mood. It draws the audience into the scene to where they can feel the same pain and sorrow that the actors feel. John Coffey places his lips over the warden’s wife’s lips to retrieve the sickness of the cancer from her body. The chandelier begins to brighten and the sound of the music increases as the scene becomes more intense. There is a sign of bright lighting coming from the woman’s mouth illustrating the cancer leaving her body and going into Coffey’s body as his mouth brightens as well. That lighting is symbolic for the cancer that Coffey took away from her. Then he closes his mouth and the light goes away. However, there is still a bright light on the woman’s face for a couple of seconds as she lies there with her eyes closed, but now her face looks healthy and so young. The lighting in this scene affects the overall story of what the director is trying to tell the audience because it tells you without words what the characters in the film are feeling. It tells you that they are saddened when the light is dim and then in awe and disbelief as it brightens. The warden was in tears and was in disbelief from what he had just scene. So were the rest of the guards. Although, they were in disbelief, they also displayed a sign of relief in that the sickness has left the woman’s body. The film setting was the summer of 1935 when Hanks was a corrections officer in charge of death row inmates at Cold Mountain Penitentiary during the Great Depression days. This is during the time where unemployment was very high. It only got worse in time before it got better. Even taxes had increased which made it that much more difficult for people to survive. During this period of time racism still existed in this culture. John Coffey was beaten, convicted and sentenced for execution all because he was a black man suspected of raping and killing two little white girls with no valid proof. Costuming can tell us almost everything we need to know about a character. The costuming of the woman showed a great deal of sickness within her face. The makeup on her looked so believable that it almost looked like she was a rotting corpse. Then the costuming took a turn as she was healed from the sickness. She became beautiful and peaceful. Elements play a significant role in affecting the film’s plot. For example, Coffey was dirty and sweaty because it was hot. So this illustrated that he was not clean and did not have any clean clothes. He did not come from a place where he had nice attire. Now if he was clean and had on fresh clothes, the scene would not be as emotional. Nobody really expected Coffey and the way he looked to have such supernatural powers except for Hanks because he had already experienced it for himself. Hairstyle and makeup can help tell the story by showing how the character may feel at that point and time in a scene. It can also set the tone of the scene and the audience can feel exactly what the characters are feeling based on how they look. As the warden puts his hand over his mouth, and the screen zooms in on his face, you can see the stress and pain in his eyes when they start to tear up. The three guards are well dressed in uniform. They have ties and hats. They all look very sharp like they’re about to conduct a ceremony. They are well groomed with no facial hair just like military service members in uniform. The guard’s hairstyle and make up tell the audience that they care about their appearance and how they carry themselves as correction officers. They guards display a sense of caution because Coffey is a convicted criminal, but at the same time they display hope as Coffey talks to the warden’s wife and begin to use his supernatural power. In my personal opinion, I think that the mise en scene was very well put in this movie. The use of color which made the room dim definitely heightened the suspense of the film especially during the particular scene where the light goes from dim to bright and then dim again. The warden and the guards were in well placed positions while Coffey sat on the bed and performed his supernatural miracle to cure the warden’s wife from her sickness. The mise en scene was done very well by illustrating that the woman was sick and then healed by a miracle performed by a black man who was wrongfully convicted and sent to death row while he awaited death by electric chair. All of the elements flowed in a harmonious way because the music went well with the lighting when it was dark, and then became bright when Coffey used his super natural powers to heal the sickened woman. The audience is easily drawn into the film because of the cinematography that takes place in the movie. The actors, lighting, music and setting go hand in hand together. Therefore, it is not discordant at all. The design elements are definitely in sync with Frank Darabont’s vision. From the beginning of the scene, the elements in the film were symbolic to his vision. He wanted the audience to feel every bit of emotion that the characters were feeling. The intensity as Coffey spoke to the warden’s wife grew as he introduced himself to the time he ridded her from the illness. Not only did it make the warden cry and the guards emotional, but I’m sure that the audiences who watched this movie were just as emotional as everyone in the film. So Darabont did a great job by piecing everything together to get the right vision for the scene. The Green Mile had great chemistry as everyone played key roles in making this film. The film could not have been accomplished without the help of everyone coming together and doing their part, from the directors to the actors. The elements of the mise en scene were symbolic throughout the movie so that it really touched the audiences. It placed the viewers in the film as if they were part of the script. The director and the cinematography of the film gave it the extra edge that was needed aside from the actors. Will Biofuels Solve Global Warming

Will Biofuels solve global warming? Global warming is caused by greenhouse gasses; these trap heat in the earth’s atmosphere that should escape from the earth. Global warming is causing sea levels to rise and ice caps to melt this could lead to coastal cities flooding, droughts in area’s which usually get rain and less crops to list only a few affects. The cause of global warming is â€Å"greenhouse gasses† these gasses include nitrous oxide carbon dioxide and water vapour.Cars produce CO2, H20 and trace amounts of nitrogen oxide all greenhouse gases, with the amount of cars on the road surpassing the 1 billion mark in 2010 according to Ward’s Auto with the average car realising 7 tons of CO2 each year it is easy to see why cars are one of the biggest contributors to global warming, producing energy for factories to work also produces harmful gases one solution to this problem is Biofuels. Biofuels is the term given to living or recently living biological material which can be used to fuel cars and other forms of transport they can be derived from any Biomass include animal waste products. Also read: What Unique Challenges Do Aquatic Plants Face That Terrestrial Plants Do NotOne of the main advantages of Biofuels is that they are almost carbon neutral; when a crop is growing it performs photosynthesis to create sugars and other organic compounds that provide energy during this process plants take in CO2 when these crops are turned into Biofuels and burned this CO2 is realised back into the atmosphere as no more CO2 has been added it is carbon neutral however some CO2 is produced in transporting these crops and turning them into Biofuels so they are not completely carbon neutral.Unlike fossil fuels such as petrol Biofuels are a renewable energy source this means they will not run out as crops can be grown back relatively quickly. Biofuels can be created anywhere in the world meaning it is accessible to many people. Biofuels are also cheaper to run than petrol or diesel with the price of petrol rising due to it depleting amount Biofuels are cheaper to attain. Other benef it of Biofuels is that they provide jobs and industry for many farmers all over the world.One popular type of Biofuel is Biodiesel which has many advantages * Simpler to make than other Biofuels such as Ethanol * Burn up to 75% cleaner * Provide new source of income for farmers However Biofuels also have their disadvantages one of the main problems is the land needed to produce the crops. In the UK in 2010 71. 61 % of the UK land was used in agriculture this left around 28. 39 % of land for other uses, coming of the lack of land environmentalist worry that the habitat of any animals and wild plants creating the room to grow Biofuels.At this moment in time Biofuels are not sustainable without affecting the price of food and production. Though Biofuels will give farmers more income however it will give farmer more income than growing crops does this leads to the danger of farmers stopping the growing of crops to grow Biofuels this could lead to less food production and ultimately star vation. Biodiesel also has disadvantages *   sustainability issues * Making biodiesel is not very efficient Biodiesel cannot meet the demand of diesel.Biofuels are not the only alternative fuels Hydrogen fuel cells could also be used in cars to power them they are cleaner than most fuels. Electrical cars are also become increasingly popular however unless the electricity is produced using Biofuels they can still be damaging on the environment. There is no definitive answer to â€Å"Will Biofuels solve global warming† as the issue we are in is far too complex for just one solution, Biofuels along with other renewable energy sources e. g. wind turbines and hydroelectric power would provide a more viable solution to global warming.

Herzbergs Two Factor Theory Essay

1.0 INTRODUCTION Motivation is an important driver in an organisation and is crucial to the management of intellectual capital. Motivation underlies what employees choose to do (quality and/or quantity), how much effort they will put into accomplishing the task, and how long they will work in order to accomplish it. Employees who are motivated will work more effectively and efficiently and shape an organisation’s behavior. A motivated workforce will have a strong effect on an organisation’s bottom line. Motivation is strongly tied to job satisfaction. Job satisfaction is how individuals feel about the tasks they are supposed to accomplish and may also be influenced by the physical and social nature of the workplace. The more satisfied employees are with their jobs, the more motivated they will be to do their jobs well. There are several important studies relating to motivation. These include Abraham Maslow’s hierarchy of needs, Frederick Herzberg’s study of hygiene and motivational factors, Douglas McGregor’s Theory X and Theory Y, Victor Vroom’s Expectancy Theory, and J. Stacy Adams’ Equity Theory. It is worth noting that the paper will give some highlights of the above mentioned theories so as to give a bigger picture on the subject of motivation, further the paper will give brief definitions of some key concepts such as motivation and job satisfaction. It is also important to state here that the paper will restrict itself to the two factor theory by giving a brief explanation on the theory and then zero in on each of the hygiene factors in detail after which the position of the author on the subject under discussion will be outlined and the conclusion shall follow with the bibliography. 1.1 DEFINITIONS OF KEY CONCEPTS As posited by Vroom (1964), the word â€Å"motivation† is derived from the Latin word movere, which means â€Å"to move†. Motivation is an internal force, dependent on the needs that drive a person to achieve. Schulze and Steyn (2003) affirmed that in order to understand people’s behaviour at work, managers or supervisors must be aware of the concept of needs or motives, which will help â€Å"move† their employees to act. Locke (1976) defines job satisfaction as the positive emotional state stemming from valuation of a person’s experience associated with the job. Job satisfaction is associated with salary, occupational stress, empowerment, company and administrative policy, achievement, personal growth, relationship with others, and the overall working condition. It has been argued that an increase in job satisfaction increases worker productivity (Wright & Cropanzano, 1997; Shikdar & Das, 2003). Therefore, job satisfaction has a major effect on people’s lives. Locke (1976) indicated that job satisfaction most commonly affects a person’s physical health, mental health and social life whereby people who are satisfied with their jobs will tend to be happy with their lives. Breed and Breda (1997) indicated that job satisfaction may affect absenteeism, complaints, and labour unrest. In view of this, satisfied workers will be much more productive and be retained within the organisation for a longer period, in contrast to displeased workers who will be less useful and who will have a greater tendency to quit their jobs (Crossman, 2003). More importantly, satisfied workers not only perform better but also provide better service to customers, which could result in improving customer satisfaction. It is assumed that motivation and satisfaction are very similar and that, in many cases, they are considered to be synonymous terms. According to Hersey and Blanchard (1988), motivation and satisfaction are quite different from each other in terms of reward and performance. The authors point out that motivation is influenced by forward-looking perceptions about the relationship between performance and rewards, whereas satisfaction involves how people feel about the rewards they have received. In other words, motivation is a consequence of expectations of the future while satisfaction is a consequence of past events (Carr, 2005). Researchers have given considerable attention to employee job satisfaction because it is closely related to the quality of the employee’s life. Jenner (1994) insisted that increasing the employee’s job satisfaction or morale is an important technique for eliminating absenteeism, reducing turnover, and eventually raising productivity. Barber (1986) found that job dissatisfaction was associated with greater absenteeism and higher turnover rates. With high job satisfaction, the employee tended to show stronger organizational commitment and higher intention to remain with the company. 1.2 UNDERSTANDING MOTIVATION USING THEORIES Theories of motivation can help us understand why people behave as they do. No theory has a Universal approach to explain human behaviour, because people are too far complex (Donnelly, et al.1996). Two important groups of theories are content theories and process theories. Content theories are concerned with identifying what factors in an individual or the work environment energise and sustain behaviour. Process theories try to describe how behaviour is energised, directed, and sustained. Process theories first attempt to define variables in choice, i.e., Should I work hard? (Choice); how hard do I Work? (Persistence). Maslow’s Hierarchy of Needs posits that behavior at a particular moment is determined by the strongest need. He placed them in a framework referred to as the hierarchy of needs because of the different levels of importance. Those needs that come first must be satisfied before a higher-level need comes into play. Equity Theory posits that perceived inequity is a Motivational force. Workers evaluate equity using a ratio of inputs to outputs. Inputs include qualification, experience, effort, and ability. Outcomes include benefits. Inequities occur when workers feel that outcomes are not compatible with inputs. Expectancy Theory asserts that employees are motivated to make choices among behaviors. If employees believe that effort will be rewarded, there will be motivated effort, that is, they will decide to work harder to receive a reward. Expectancy is the belief that certain behaviours will or will not be successful. Preferences are the values a person attaches to different outc omes. 2.0 THE TWO FACTOR THEORY Herzberg’s two-factor theory of motivation (1959) explains and studies the factors that play a key role in making the employees of an organisation satisfied or dissatisfied with their work and job profiles. The two factors are- hygiene factors and motivators. If hygiene factors are absent, they can lead to creation of dissatisfaction among workers, but when they are adequate, they alone cannot lead to satisfying workers in the work environment. On the other hand, motivators are the factors that are related to the nature of the job and play a significant role in providing satisfaction among workers and leading to higher level of motivation (Bassett-Jones and Lloyd 2005). Employees all over the world not only want job security but also want quality employment. They desire to be given ample opportunities for advancement, good working conditions, and fair treatment by managers, autonomy on their work, challenging jobs and responsibility (Miner 2003). These factors are included in the motivator factors given by Herzberg and still hold true today in contemporary business environment. Today’s organisations focus on teamwork and cohesion among the group so as to create an inductive environment for work where employees are motivated to work and contribute to attaining the goals of the organisation. Cock and Davis (1990) demonstrate that work quality is one of the major factors that determine satisfaction among employees in terms of motivation. For instance, if an employee has adequate money, but he has no meaningful work, then the employee starts feeling lack of self value, which is again in coherence with the Herzberg’s theory that when money stops being the driving force of motivation for employees, psychological rewards take its place and become more crucial as well as significant in terms of acting as a driving force of motivation. So, money stops acting as the motivator for employees beyond a certain threshold (Critical Analysis of Adam J. Stacy’s and Frederick Herzberg’s Theories on Job Satisfaction of Employees 2012). In today’s business scenario, sources of satisfaction at work and the ways in which jobs can be designed so as to make the work itself more challenging and enriching can motivate employees and help organisations attain their aims and goals as mentioned in Herzberg motivation theory (Locke and Latham 2004). Herzberg stated that the only way to motivate employees in the organisation is to give them challenging work so that they can feel a sense of responsibility as well as belonging towards the organisation. Today, employees are involved in decision making due to which they feel more responsibility as well as find themselves at a higher level of motivation. Intrinsic drivers dominate over external stimuli in terms of motivation and lead to enhanced contributions towards organisational success. According to Herzberg’s book on Work and the Nature of Man 1973, he says man has two sets of needs: his need as an animal to avoid pain, and his need as a human to grow psychologically. The biblical personages of Adam and Abraham are used to illustrate and develop the duality of man’s nature. Briefly, as Adam, man is pictured as an animal whose overriding goal is to avoid the pain inevitable in relating to his environment. On the other hand, looking at man in his totality, in addition to his avoidance nature there exists a human being who is impelled to determine, to discover, to achieve, to actualise, to progress and to add to his existence. These needs summarise the Abraham concept of man Work and the Nature of Man 1973. A basic understanding of the concept is that man exists as a duality and has two sets of needs present at the same time. Another interesting and important aspect of man’s dual nature follows in that the two sets of needs of man are essentially independent of one another. That is, each of the two concepts of man consists of a system of needs that operate in opposing directions. Furthermore, seething the needs of one facet of man (Adam) has little or no effect upon the needs of the other facet in man (Abraham). It should be noted that since both sets of needs exist in man at the same time both must be served and one will not substitute for the other. To illustrate, one cannot find happiness simply by avoiding physical pain, or avoid pain by finding happiness. From this illustration it becomes apparent that happiness and pain are not polar opposites of the same feeling originating from the same source; that is, happiness and pain are not on the same continuum. This is the principal upon which the Herzberg two-factor theory is based. Job satisfaction and job dissatisfaction represent two separate and distinct continua just as observed earlier with respect to happiness and pain. Herzberg offers another analogy-as follows-to help explain this way of thinking about job attitudes; let us characterise job satisfaction as vision and job dissatisfaction as hearing. It is readily seen that we are talking about two separate dimensions, since the stimulus for vision is light, and increasing and decreasing light will have no effect on man’s hearing. The stimulus for audition is sound, and, in a similar fashion, increasing or decreasing loudness will have no effect on vision. Herzberg analysed and classified the job content factors or satisfying experiences as follows –Achievement -Recognition -Work itself -Responsibility-Advancement –Growth. According to Herzberg, these factors stand out as strong determiners of job satisfaction. Job responsibility and advancement being the most important relative to a lasting attitude charge. Achievement, more so than recognition, was frequently associated with such long-range factors as responsibility and the nature of the work itself. Recognition which produces good feelings about the job does not essentially have to come from superiors; it may come from subordinates, peers, or customers. It is interesting to note that recognition based on achievement provides a more intense satisfaction than does recognition used solely as a human relations tool divorced from any accomplishment, The latter does not serve as a satisfier, Rush, H. M. F. (1969- 92-93; 9:370) Compared with the satisfiers or motivators are the factors which cause low job attitude situations or job dissatisfaction. Such factors were found from the analysis of the study results to be associated primarily with an individual’s relationship to the context or environment in which he does his work. These factors are extrinsic to the work itself and are referred to as dissatisfiers or hygiene (or maintenance) factors. Herzberg categorized the context or environmental factors causing dissatisfaction to include: Dissatisfies: – Company policy and administration – Supervision – Working conditions – Interpersonal relations (with peers, subordinates and superiors) – Status – Job security – Salary – Personal Life 3.0 Hygiene Factors Why, for instance, do hygiene factors serve as dissatisfiers? Why, on the other hand, do motivators affect motivation in the positive direction? Consider the answers to these questions in terms of the distinction between the two sets of human needs (Adam vs Abraham). One stems from man’s animal nature and his need to avoid pain. This set consists of the needs for which the hygiene factors are relevant. The word â€Å"hygiene† is a medical term meaning preventative and environmental. This is an –appropriate term in view of the fact that the hygiene factors represent the environment to which man as an animal is constantly trying to adjust. The dissatisfies or hygiene factors previously listed are the major environment aspects of work. Because these factors serve only to reduce pain, they cannot contribute to positive satisfaction but only to the avoidance of dissatisfaction. Herzberg found, for example, that good working conditions (Physical, environment, congenial co-workers, good supervision) were rarely named as factors contributing to job satisfaction; however, poor working conditions were frequently cited as sources of dissatisfaction. Herzberg argued that improvement in the hygiene factors would only minimise dissatisfaction but not increase satisfaction and motivation. In order to motivate employees, the managers must ensure to provide the hygiene factors and then follow the motivating factors. When hygiene factors are adequate, people will not be dissatisfied; but at the same time they may not be fully satisfied. They will be in a neutral state. If we want to motivate people on their jobs, it is suggested to give much importance on those job content factors such as opportunities for personal growth, recognition, responsibility, and achievement. These are the characteristics that people find intrinsically rewarding. Herzberg model sensitises that merely treating the employees well through ‘good’ company policies is not sufficient to motivate them. Managers should utilise the skills, abilities, and talents of the people at work through effective job designing. In other words, the work given to employees should be challenging and exciting and offer them a sense of achievement, recognition, and growth. Unless these characteristics are present in the job, employees will not be motivated. A company policy that treats workers well may not be motivation in itself if there is no clear career progression plan or it hinders progression whether through strict staff development policy or lack of provision of scholarships. For example, some companies have policies that a worker needs to serve a minimum of 8 years for them to be granted paid study leave without sponsorship; in view of the life expectancy which is significantly reduced, it may not be possible for an employee to wait for that long. Additionally, an employee may have added responsibilities such as taking his children to school thereby making it extremely difficult for them to pay for their own studies. It is important to note that even in situations where this policy is elaborate, it may not bring motivation in itself unless it be accompanied by a motivator such as personal growth or recognition. There are a number of managerial styles that are adopted by different supervisors; some are strict and do not consult while others are open and make workers autonomous. The quality of supervision alone, however, will not motivate a worker. Even when the supervision is good, it may not motivate a worker unless this good supervision is coupled with achievement, where the worker is given a normal task load and these tasks are smart in nature. Only then can this be a source of motivation. Despite being good, the supervisor must be seen to apply the concept of equity in dealing with subordinates, if this aspect is absent, then the workers may be dissatisfied Factors that involve the physical environment of the job: amount of work, facilities for performing work, light, tools, temperature, space, ventilation, and general appearance of the work place. In a company were working conditions are poor, workers will not be motivated to work. For example, a receptionist who works in a small and stuffy room will not be motivated to go for work the following day. Even if such a person worked in an air conditioned room with good chairs, but the company does not recognise her contribution to the organisation, she may decide to leave the organisation because she will not be motivated. So it is only when these factors are combined that one will be motivated. For example, when such a worker’s contribution is recognised even by management writing her a letter of appreciation, then there will be motivation and satisfaction. When it comes to job security, which is employee’s job tenure and/or the company’s stability or instability, objective signs of the presence or absence of security, it is worth noting that when a job is secured it will produce a good feeling or the psychological well being of the employee will be good. However, on its own, it cannot provide motivation unless a balance is struck between the motivators and hygiene factors as outlined by Herzberg In Herzberg’s two-factor model pay is a maintenance factor that should not contribute significantly to motivation. The money that employees receive is actually a package made up of salary, and other fringe benefits such as transport, housing, furniture, medical allowance. Others include meal subsidy and utility allowances. This pay is given across the board or is universal and, therefore, a worker will not feel anything special about this pay unless it is given to workers who have performed exceptionally well and not to everybody else. In this case, it becomes a merit pay. For example, a government worker who has been in service for five years at a given position will be given the same salary as someone who has just graduated from the university because they have the same position and qualification and salary scale. In such a situation, salary will not be a motivation for the one who has served longer. In view of this, the employee who has worked for five years will only be motivated if his salary is different on account of performance and length in service. Here, we see an aspect of recognition coming into play. In expectancy theory, pay can satisfy a variety of needs and influence choice and behavior, while in equity theory, pay is a major outcome that one compares with other employees. The relationships between the worker and his or her superiors, subordinates, and peers-by which we mean the related interactions and social interactions within the work environment-play a major role in determining how employees feel about their work. Ordinarily a good and warm relationship with one’s supervisor would entail no dissatisfaction on the part of the worker. However, if the company does not recognise one’s effort or contribution to the organisation, then they will not be motivated. Member states, institutions and individuals in the EU are bound by the constitutional principles developed by the ECJ when they act within the community. In a series of decisi ons, passed in the 1960s and 1970s, the ECJ established doctrines that have served as precedents of a theory of legal intervention into the relationship between Member States and the Community. In an apparently activist approach, the ECJ held that the provisions of the Treaty could have a direct effect in its ruling on the 1963 Van Gend en Loos case. This essentially means that individuals and private citizens could sue national governments in the national courts for failing to enforce the Treaty. In its declaration, the ECJ stipulated that the Treaty is superior to an agreement that creates mutual obligations between contracting states insisting that the Community constitutes a new legal order of international law limiting the sovereignty of states within limited fields (Abels and Joyce 59). In the case of Costa v. ENEL, the ECJ established the supremacy doctrine meaning that state transfers of legal powers were irreversible and permanently limited their sovereign rights. In its ru ling, the ECJ decreed that the EEC treaty was no ordinary international treaty and had its own legal system which upon enforcement of the Treaty became an integral part of the legal systems of Member States and their courts were bound by the system. It further stated that the creation of a community of unlimited duration, with its own institutions, personality, legal capacity, capacity of representation on the international plane and most importantly, real powers limiting sovereignty of Member States or the transfer of power from the states to the Community, members had effectively limited their sovereign rights, within limited fields, creating a body of law binding their nationals and themselves(Abels and Joyce 59). In the Francovich case, the court resolute that the failure of Member States to swap orders amounts to a breach of Community law and as such were obliged to compensate harm suffered by individuals. The war of 1812 was when war broke out again between the United States and Britain. There are three main causes that led to the war of 1812, Impressment, the British Incitement with the Indians, and the war hawks. Although there may be other factors that one may say caused the war, these topics are the major causes, and are what impacted America. In this essay I will explain the causes in detail and provide you with a greater understanding of the causes of the war of 1812. The issue of impressment and the interference of trade are both what caused the war of 1812.One of the main issues between the United States and Britain was because of blockades that were used to seal up Britain’s ports and prevent ships from entering or leaving. Because of the blockade Britain seized more than 1,000 American ships and confiscated their cargo. Also the embargo act affected the trade between the two countries, because it put a ban on exporting products to other countries. The US thought this act would make the British honor American neutrality, but it actually backfired and hurt the US more than it did to Britain. The ban was lifted on foreign trade in 1809, except with Britain and France. Impressment was the practice of seizing US ships and drafting them into the British navy. America focused their anger on the British because of impressment. The British viewed impressment as a gain for their navy, they needed more man power to fight in war. America was angry the practice of impressment, and they feared if they lost they would lose independence. The irony of the issue of impressment as a cause for the war was, that two days before we went to Britain, they lifted the British policy of impressment but it was no longer an issue. Another cause of the war of 1812 was the British incitement with the Indians. Tecumseh was the Shawnee chief who formed a confederacy and began negotiations with Britain for assistance in defeating America, and continuing to press Hamilton and his white settler to withdraw from the Native American land that Tecumseh wanted all to himself. The British were providing the Indians with weapons because they had an alliance and they both wanted to create a war with America because of the trade issues that went on beforehand. The Indians were taking the weapons from the British because they needed an additional support in order to gain the land they wanted. Because the British were supplying Indians with weapons the Americans felt under attack. The last cause of the war of 1812 was the group known as the war hawks. The war hawks were a group of young congress men from the south and the west of the united states. They called for war against Britain, because they found out that the Native Americans were being supplied with weapons from the British. They thought it was unfair because they were being pushed to withdraw from their land and to hand it over to the natives, but the natives were allied with Britain and had a larger army and more weapons, and it gave them a greater advantage. The US military was unprepared before the war began; they were not as strong and equipped as the British were. In conclusion the main causes of the war of 1812 were impressment, the British incitement with the Indians, and the war hawks. The British policy of impressment caused anger to arise in America, because of the seizing of their ships. As in letter from the commander of the U.S.S. Chesapeake stated â€Å"at 150 yards range they fired their first broadside. It came without warning†¦ nor were we prepared to fight†, the British took advantage of the US because they were unprepared, and the British were confident and well equipped. The British incitement of the Indians also caused great tension in America. The Indians were being armed with British guns, and they used them to attack the US and gain land.
